The sale of products on this website is regulated by the following General Conditions of Sale that are applied by the company Marco Manetti Milano S.r.l., with registered office in Italy, via Pomè n. 14, 20017 Rho (Mi), enrolled in the Companies’ Register of Milan with fiscal code and VAT number 11014110966 REA 2572627 with a share capital of euro 50.000 fully paid up.

TRADE POLICY

The end users of our electronic commerce activity are exclusively end users, who are consumers and not for business or professional purposes. We reserve the right not to follow up on orders that do not follow or do not comply with our business policy.

HOW TO CONCLUDE A CONTRACT 

1. Order form

   To conclude a purchase contract on the site www.marcomanetti.com fill in the Order Form in electronic format and send it electronically following the instructions.

   Before sending it, read carefully the General Conditions of Sale and accept them.

2. Order Acceptance

   Upon receipt of the order form filled in all its parts we will take charge of your purchase order.

   Every order is assumed with “Reserve of acceptance” by Marco Manetti Milano S.r.l.

   In case the products are no longer available or on sale, we will communicate promptly and in any case not later than 10 days the possible unavailability.

3. Order Confirmation

   The products sold on our Site are marked with the Marco Manetti Milano brand and are not used or irregular products.
   The essential characteristics are presented in the product cards available on the Site.

4. Products

   After acceptance of the contract, we will send you by e-mail a Confirmation of Purchase Order, containing a summary of the essential characteristics of each product ordered, the price including any additional costs for the types of shipping and delivery chosen by the customer and the General Conditions of Sale signed.

5. Measures

   They are expressed in centimeters (cm) and refer to the total dimensions.
   With reference to the upholstered furniture, please note that they are handmade products and the real measures may not be perfectly coincident with those indicated on the website www.marcomanetti@com or in the reference price lists.

6. Materials and Coatings

   Marco Manetti Milano S.r.l. realizes Made in Italy products using precious and exclusive materials. The Company’s choices are mainly oriented towards natural products which, as such, have similar characteristics, but never the same. Each material or coating used is therefore subject to variations in shade and color due to the specificity of the product, time or different climatic conditions (natural light, artificial light, humidity, etc.).
   In consideration of the above, each sample color is to be considered as purely indicative and Marco Manetti Milano S.r.l. declines any responsibility in relation to the lack of coincidence in the characteristics of the materials of the supplies and above all in relation to the differences found in products purchased at different times.
   Woods
   Variations in color tones, the arrangement and size of the grain and the presence of knots are to be considered qualities that distinguish the product. Natural and artificial light, as well as environmental humidity, produce tonal variations that are not to be considered defects of the raw material used.
   Hides and Leather
   Differences in gloss, creases or different surface textures attest to the authenticity of the product and are not to be considered defects attributable to the poor quality of the raw materials used for production. Fabrics
   Slight differences in warp and weft, as well as in the structure of the fabric, together with slight differences in color tones, are intrinsically linked to the processing methods, especially if they refer to different production batches made at different times and are therefore not to be considered defects of the raw materials used.
   Marbles
   Each marble is unique in the arrangement of veins and colors. Surface irregularities, small holes and inclusions of various types are not to be considered defects, but rather proof of exclusivity.
   Metals
   The surface treatments of metals show similar characteristics, but subject to change over time that make the product unique and exclusive and are not to be considered defects of the metals used.

7. Guarantee of Authenticity

   Marco Manetti Milano S.r.l. guarantees the authenticity of the products purchased directly from its official website.
   Marco Manetti Milano S.r.l. guarantees the structures of the upholstered products for 2 years from the delivery date. The upholstery in fabric or leather, the padding, the mechanisms, the accessories and the components are also guaranteed for 2 years, as well as the tables, coffee tables, bookcases, containers and carpets.

8. Improvements

   Marco Manetti Milano S.r.l. reserves the right to make improvements to all its models of a technical or aesthetic nature, specifically in the measurements and materials used, which do not substantially alter the image of the product, without prior notice.

9. Pricing

   The prices to the public are in Euro and VAT excluded and are intended Ex warehouse of Marco Manetti Milano S.r.l..
   The cost of transport, assembly and other ancillary charges are not included in the price expressed on the Site and will be communicated by us in the Order Confirmation.

10. Payments

    – Advance payment Upon receipt of the order confirmation, the customer must pay the deposit as indicated therein, equal to 50% of the amount of the order, within 10 calendar days.
    Payment must be made by bank transfer to the account entitled to Marco Manetti Milano S.r.l.

    Marco Manetti Milano S.r.l. cannot carry out the order in case all the sale conditions are not satisfied and it will inform the customer by e-mail that the contract is not concluded and that it has not carried out the order, specifying the reasons.

    – Balance Marco Manetti Milano S.r.l. will communicate by e-mail to the customer when the ordered products will be completed and the amount of the balance of the order.
    Verified the payment of the balance, the items will be ready for pick up free warehouse Marco Manetti Milano S.r.l. or for shipment, as agreed in the order confirmation.

    The buyer has to respect the terms of payment subscribed in the order confirmation; otherwise, Marco Manetti Milano S.r.l. reserves the right to suspend the supply of the goods.

    After 10 calendar days from the unfulfilled request of balance, the products will remain in the availability of Marco Manetti Milano S.r.l. and the deposit paid by the customer at the moment of the order confirmation will be kept by Marco Manetti Milano S.r.l. as a refund for the expenses already sustained, except for further and higher damages.

    In case of serious non-fulfilment or unjustified withdrawal of Marco Milano S.r.l. occurred after the acceptance and confirmation of the order, the customer will be entitled to claim the double amount of the deposit, after having sent a formal notice of fulfilment which remained unobserved for 10 days.

11. Delivery

    a. Pickup from our warehouse

    Unless otherwise agreed in the order confirmation, once the balance is paid, the customer will be informed about the modalities of withdrawal of the products at the warehouse of Marco Manetti Milano S.r.l..

    b. Shipping

    Shipping conditions vary according to the destination country.

    Marco Manetti Milano S.r.l. will evaluate and propose different solutions according to the destination of the products.
    All the goods shipped by third parties travel at risk and danger of the customer.

    Delivery times reported in the order confirmation are indicative and not binding.

    Marco Manetti Milano S.r.l. uses third companies for the delivery of the products and possible delays not directly attributable to Marco Manetti Milano S.r.l. cannot cause any compensation to the customer.

    Marco Manetti Milano S.r.l. reserves the right to charge the purchaser for any additional costs due to special requests of the customer, such as packaging in wooden boxes or anything else.

    b1. Shipping with courier street level

    The delivery will be made by the courier selected by Marco Manetti Milano S.r.l. and it will be intended at the street level in front of the house number indicated in the delivery address. The mode of delivery will be communicated to the customer by e-mail or as specified in the formalization of the order.
    This mode does not provide the service of unpacking and assembly.

    b2. Shipping by courier to the floor

    The delivery will be carried out by the courier selected by Marco Manetti Milano S.r.l. and it will be intended on the threshold of the place of destination indicated in the delivery address. The mode of delivery will be communicated to the customer by e-mail or as specified in the formalization of the order.
    This modality does not foresee the service of unpacking and assembly.

    b3. Shipping by courier to the floor with assembly

    In some cases it is possible to provide for the delivery and assembly of the product at the place indicated when formalizing the order. This mode does not include and does not include ancillary services (such as, but not limited to, wall fixings and drilling services). The mode of delivery will be communicated to the customer by email or as specified in the order formalization.
    The disposal of packaging materials is charged to the customer.

12. Complaints

    Possible discrepancies between the supply and the order confirmation, or possible defects or faults of the supplied products, have to be promptly reported by means of the specific Claims and Returns Form to Marco Manetti Milano S.r.l. and anyway within 60 calendar days from the receipt of the goods.

    All Marco Manetti Milano S.r.l. products are provided with a label which is used for the univocal identification of the product and which must not be removed in case of return.

    The vendor has the right not to accept the return or not to fully refund the amount paid for the purchase of the products without the label, or that have been altered in their essential or qualitative characteristics, or that have been damaged or are without the original packaging.

    We do not accept returns if not previously authorized in writing by Marco Manetti Milano S.r.l..
    Returns must be delivered, free of any expense, to the place indicated in the authorization.

13. Right of withdrawal

    a. Return procedure

    Our aim is the complete satisfaction of the customer.

    If the customer intends to exercise the right of withdrawal, he has to communicate it to Marco Manetti Milano S.r.l. within 14 calendar days from the withdrawal of the product from our warehouse or from the delivery of the courier in charge, as it results from the shipping documents.

    The communication must be made by filling in the Return Form (according to the standard form of the art 49, paragraph 4 of the Consumer Code) that you can find on the website in the Customer Service area, to be sent electronically and by registered mail addressed to:

    The date of the postmark will be considered as the date of sending.

    The communication must indicate the personal details of the holder of the order, the references of the order confirmation, the product that the customer intends to return and the bank details of reference for any refund.

    Before proceeding to the return of the item, the customer will have to receive a written Return Authorization by e-mail from Marco Manetti Milano S.r.l., where the place where the product will be returned will be indicated.

    Independently from the chosen return modality, the expenses are entirely charged to the customer.

    In order to facilitate the return operations and to protect the product during the transport, it is necessary to reuse the original packaging materials.

    All Marco Manetti Milano S.r.l. products are provided with an identification label that must not be removed in case of return.

    Upon receipt of the product Marco Manetti Milano S.r.l. will verify the observation of all the required return conditions, such as:

    1. That the withdrawal form has been properly submitted within 14 days of withdrawal or receipt of goods

    2. That the product returned is in perfect condition and has not been used or damaged

    3. That the identification tag of the product has not been removed

    4. That the product has been returned with the original packaging

    5. That the product has been returned to our warehouse or delivered to the courier within 14 days of receipt of the Return Authorization.

    Once the respect of all the Return Conditions has been verified, Marco Manetti Milano S.r.l. will send an e-mail of Acceptance of Return and will activate the refund procedure by bank transfer to the coordinates communicated by the customer, within 14 working days from the date of receipt of the product.

    The reimbursed price will be exclusively represented by the cost of the product net of eventual shipping costs and/or accessory charges resulting from the order confirmation, and shipping costs and/or accessory charges due to the return modality, which remain the exclusive competence of the customer, since the standard delivery modality is ex warehouse Marco Manetti Milano s.r.l.

    The customer will be contacted if his return cannot be accepted because it does not comply with the Conditions of Return. In this case, he can choose to have the purchased products back at his own expenses. In case of refusal we reserve the right to retain the products and the amount corresponding to the purchase price of the products.

    In some cases, it may be proposed to accept a reduction of the refund, which will be communicated, due to the decrease in value of products returned. In case of refusal, we reserve the right to retain the products and the amount indicated for the reduction of the refund due to the decrease in value of the products returned.

    b. Exclusions

    Pursuant to art. 59 of the Consumer Code, the right of withdrawal referred to in Articles 52 to 58 for distance contracts and contracts negotiated away from business premises is excluded, as far as it is relevant to this type of supply, in relation to:

    • service contracts after full performance of the service if performance has begun with the consumer’s express agreement and acceptance of the loss of the right of withdrawal following full performance of the contract by the trader;

    • the supply of goods or services whose price is linked to fluctuations in the financial market that the trader is unable to control and that may occur during the withdrawal period;

    • the supply of made-to-measure or clearly customized goods;

    • the supply of sealed goods that are not suitable for return for hygienic or health protection reasons and have been opened after delivery;

    • the supply of goods which, after delivery, are, by their nature, inseparably mixed with other goods;

    • contracts where the consumer has specifically requested a visit from the trader for the purpose of carrying out urgent repair or maintenance work. If, on the occasion of such a visit, the trader provides services in addition to those specifically requested by the consumer or goods other than spare parts necessary to carry out the maintenance or repairs, the right of withdrawal applies to those additional services or goods;

    In compliance with the above-mentioned discipline, the customer is therefore informed that there is no right of withdrawal for the order that can be traced back to one or more of the above-mentioned cases of exclusion.

    In particular, taking into account the specific typology of the goods supplied by Marco Manetti Milano S.r.l., by their nature characterized by personalization and uniqueness, as well as by the use of valuable and exclusive materials, we inform you that the right of withdrawal is excluded, unless otherwise agreed in writing between the parties, whenever the order involves the production of one or more goods on the basis of specific indications provided by the customer through the configuration software of this website, or through any other communication channel useful for this purpose.

14. Change and cancellation of Orders
    The variation and/or the cancellation of the undersigned order is valid only if accepted in writing by Marco Manetti Milano S.r.l., which reserves the right to keep the possible deposit paid by the customer as a refund for the expenses already sustained.

15. Disputes

    Any disputes arising from the supplies will be attributed to the exclusive jurisdiction of the Court of Milan.
